Terms of Service

These Terms explain how Echoes of Legacy works, what users may store and share, how subscriptions operate, and the responsibilities that come with preserving messages, memories, files, and memorial materials for future delivery.

Important: Echoes of Legacy is not a law firm, fiduciary, estate executor, healthcare provider, insurance provider, financial advisor, or emergency service. Our tools help you organize and preserve legacy materials, but they do not replace professional legal, tax, estate-planning, medical, financial, or grief-counseling advice.

Service operator and notices

Echoes of Legacy operates the Echoes of Legacy service described in these Terms.

Questions, complaints, and legal notices may be sent to echoes_mailer@echoesoflegacy.com.

If you require a physical mailing address for legal notices, email echoes_mailer@echoesoflegacy.com and we will provide the current address for service-related correspondence.

For governing-law and venue references in these Terms, our principal place of business will be the location identified in our current business records and launch configuration.

1. Agreement to these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and Echoes of Legacy (“Echoes,” “we,” “our,” or “us”). By creating an account, using the website, uploading content, choosing a subscription, sending invitations, creating recipients, drafting memorial pages, or otherwise using Echoes of Legacy (the “Service”), you agree to these Terms.

If you use the Service on behalf of another person, family, estate, organization, or business, you confirm that you have authority to do so and that you will be responsible for that use.

2. Who may use the Service

You must be at least 18 years old and able to form a legally binding contract to create an account or purchase a paid plan. The Service is intended for adults and is not directed to children under 13. Do not create an account for a child under 13 or submit personal information from a child under 13 unless we have expressly provided a legally compliant workflow for doing so.

3. What Echoes of Legacy provides

Echoes of Legacy provides a private legacy workspace where users may create, upload, organize, and manage materials such as:

  • future messages, letters, and notes;
  • stories, journal entries, memorial text, and obituary drafts;
  • photos, videos, files, and keepsakes;
  • recipient lists, groups, reminders, and delivery preferences;
  • memorial pages, gallery materials, and family-sharing tools.

The Service may include free and paid plans, plan limits, storage limits, administrative review tools, recipient workflows, message-release workflows, and integrations with payment, email, hosting, storage, and other service providers.

4. Legacy release and memorial workflows

Some features are designed to help preserve or release messages, memorial materials, or account content after a future event, such as user instruction, administrative review, scheduled release, recipient action, death notice, family request, or another workflow we make available.

You understand and agree that these workflows are tools, not guarantees. Releases may be delayed, blocked, paused, reviewed, or declined if we believe there is an identity issue, fraud risk, account dispute, conflicting instruction, legal concern, safety concern, technical issue, unpaid account status, suspected abuse, or other reason that requires additional review.

You are responsible for keeping recipient information, instructions, account details, and payment information accurate and current. Echoes is not responsible for failed delivery caused by inaccurate recipient information, spam filters, inactive email accounts, third-party provider failures, lack of recipient cooperation, disputes among family members, or events outside our reasonable control.

5. Your account and security

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly if you believe your account has been compromised. We may require additional verification before making sensitive changes, releasing materials, disclosing account information, or assisting a purported representative, family member, recipient, executor, or other third party.

6. User content

“User Content” means anything you or your authorized users submit, upload, write, store, generate, organize, or share through the Service, including messages, stories, journal entries, files, images, videos, recipient information, memorial content, account details, and release instructions.

You keep ownership of your User Content. You grant Echoes a limited, worldwide, non-exclusive license to host, store, back up, process, display, transmit, format, reproduce, and otherwise use your User Content only as needed to operate, secure, maintain, improve, support, and provide the Service, including carrying out your selected sharing, memorial, recipient, and release workflows.

You represent that you have all rights and permissions needed to upload and use your User Content and to authorize us to process it under these Terms.

7. Content rules

You may not use the Service to upload, store, request, share, or transmit content that:

  • is unlawful, threatening, abusive, harassing, defamatory, invasive of privacy, exploitative, or fraudulent;
  • violates intellectual-property, publicity, privacy, confidentiality, or contractual rights;
  • contains malware, credential theft, phishing, spam, or other harmful code or conduct;
  • exploits or endangers minors;
  • impersonates another person or misrepresents authority over a person, account, estate, or family matter;
  • requests or encourages self-harm, violence, illegal activity, or abuse of the Service.

We may remove content, restrict access, suspend accounts, preserve evidence, or cooperate with appropriate legal process if we believe these rules have been violated.

8. Memorial pages, invitations, and recipients

You are responsible for the people you invite, list as recipients, designate as contacts, or authorize to access content. Before entering another person’s contact information or personal details, you must have a lawful basis and appropriate permission to do so.

If you create or publish an obituary, memorial page, tribute, gallery, or other public or shared material, you are responsible for its accuracy and for respecting the privacy, dignity, and rights of the people mentioned or depicted.

9. Subscriptions, billing, and plan limits

Echoes may offer free plans and paid monthly subscription plans. Paid plan prices, features, storage limits, recipient limits, message limits, media limits, and other plan details are shown at signup, checkout, in the billing area, or on the pricing page. Taxes may apply.

Paid subscriptions renew automatically unless canceled before the next billing date. By starting a paid subscription, you authorize us and our payment processor to charge the payment method you provide for recurring fees, applicable taxes, and permitted plan changes.

You may cancel or change a subscription through the account billing area where available, through the payment-provider portal where available, or by contacting support. Cancellation generally stops future renewal charges but does not automatically refund fees already charged unless required by law or expressly stated by us.

If payment fails, your account becomes past due, or your plan is canceled, we may limit paid features, reduce available storage, prevent new uploads or releases, downgrade the account, or suspend access after reasonable notice where practical.

10. Refunds

Except where required by law or expressly stated in writing, fees are non-refundable. We may choose to issue credits or refunds at our discretion, but doing so once does not require us to do so again.

11. Storage, backups, retention, and deletion

We work to preserve content with care, but no online service can guarantee permanent storage, uninterrupted availability, or perfect backup recovery. You should keep your own copies of important materials.

If you delete content, close an account, fail to pay for a plan, violate these Terms, or if an account is inactive for an extended period, we may delete, archive, restrict, or retain content according to our product settings, legal obligations, backup cycles, dispute needs, and operational requirements.

12. Privacy

We process account information, recipient information, payment-related information, content, support requests, technical logs, and similar information to provide and secure the Service. We may use trusted third-party providers for hosting, storage, email delivery, analytics, billing, support, security, and related operations. We do not sell your legacy content.

A separate Privacy Policy may provide more detail about how personal information is collected, used, shared, retained, and protected. If these Terms conflict with a posted Privacy Policy about privacy-specific practices, the Privacy Policy controls for that issue.

13. Copyright and intellectual-property complaints

Respect the rights of others. If you believe content on the Service infringes your copyright or other rights, contact us with enough detail to identify the content, your rights, your contact information, and the action you request. We may remove or restrict allegedly infringing content and may terminate repeat infringers where appropriate.

Copyright notices may be sent to: support@echoesoflegacy.com. If Echoes designates a formal DMCA agent, we may update this section with the required agent information.

14. Third-party services

The Service may rely on third-party providers such as payment processors, email providers, hosting providers, storage providers, analytics tools, and embedded services. We are not responsible for third-party services we do not control. Your use of those services may be subject to their own terms and policies.

15. Changes to the Service or Terms

We may update the Service, features, plan limits, pricing, policies, or these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as posting an updated effective date, sending a notice, or showing an in-app message. Continued use of the Service after changes become effective means you accept the updated Terms.

16. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if we believe you violated these Terms, failed to pay, created risk or liability, infringed rights, abused the Service, compromised security, or used the Service unlawfully. We may also suspend release workflows during disputes, legal holds, verification issues, or safety reviews.

17. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Echoes disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted or error-free operation.

Echoes does not guarantee that messages, files, memorial materials, reminders, notifications, or releases will be delivered at a specific time or received by a specific person.

18. Limitation of liability

To the fullest extent permitted by law, Echoes and its owners, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, emotional distress, family disputes, release delays, failed delivery, account disputes, or service interruptions.

To the fullest extent permitted by law, Echoes’ total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to Echoes for the Service during the three months before the event giving rise to the claim, or (b) $100.

19. Indemnification

You agree to defend, indemnify, and hold harmless Echoes and its owners, officers, employees, contractors, agents, affiliates, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your User Content, your use of the Service, your violation of these Terms, your violation of law, your infringement of rights, or your instructions to release, publish, invite, or share content.

20. Disputes

Please contact us first so we can try to resolve concerns informally. To the fullest extent permitted by law, any dispute relating to these Terms or the Service will be handled individually and not as part of a class, consolidated, or representative action. Some jurisdictions do not allow certain limitations, so some terms may not apply to you.

21. Governing law

These Terms are governed by the laws of the United States and, where state law applies, the laws of the state where Echoes of Legacy has its principal place of business, without regard to conflict-of-law rules, unless consumer-protection law requires otherwise.
